Florida AG Seeks Injunction to Halt OpenAI Model Training

Florida Attorney General James Uthmeier filed a motion for a temporary injunction against five OpenAI entities and Sam Altman personally, according to court documents. The motion asks the court to bar OpenAI from developing AI models without independent third-party guardrails and approval.

The motion also seeks to stop OpenAI from providing ChatGPT to minors in Florida, collecting data from Florida children under 13 without certain procedures, representing ChatGPT as safe or reliable, ascribing false human attributes to its services, and soliciting engagement through conversation prolongation.

OpenAI reported on Friday that all training, evaluation, and inference with tool-use of its most capable models remain paused. On Monday, OpenAI spokesperson Drew Pusateri said the company will resume training only when confident additional safeguards are in place.

The filing follows a lawsuit Florida brought against OpenAI and Altman in June in Highlands County after reviewing the accused Florida State University gunman's ChatGPT logs. OpenAI had attempted to move the case to federal court, but Judge Aileen Cannon sent it back.

The injunction request comes amid heightened internal and external scrutiny. Earlier this month, OpenAI posted six misalignment reports. This month, new OpenAI board member Paul Christiano said he sees a meaningful risk of catastrophic and irreversible loss of control in the near term. Days earlier, Chief Scientist Jakub Pachocki wrote that broader interventions are required. Last week, at the UN Security Council, Altman said OpenAI should not train models unless it can make an extremely strong case that they can be kept under human control.
